1. Introduction
These Terms of Service ("Terms") govern the use of the Darkroom provided by Photo Spectrum ("We," "Us," or "Our"). By accessing or using the Darkroom, you ("Customer," "You," or "Your") agree to comply with these Terms.

2. Darkroom Access Fee
2.1. A one-time lifetime membership fee of HKD 1,500 (HKD 750 for elegible full-time Hong Kong students) is required to access and use the Darkroom if you have not completed a workshop at Photo Spectrum.
2.2. This fee grants the Customer access to the Darkroom during operational hours, subject to availability and prior booking.
2.3. The lifetime membership is non-transferable and non-refundable.

2.4 A one-time access fee of HKD 500 is payable for exemption

3. Waiver of Membership Fee for RA-4 Color Printing Workshop Attendees
3.1. Customers who has completed the RA-4 Color Printing Workshop provided by Photo Spectrum are exempt from the membership fee.
3.2. Proof of workshop attendance must be presented to qualify for this waiver.

4. Booking and Usage
4.1. Darkroom access is available by prior reservation only.
4.2. Cancellations must be made at least 48 hours in advance to avoid forfeiting booking privileges.
4.3. Misuse or damage to equipment may result in termination of access without refund.

4.4.1. Late Cancellation & No-Shows:

• Failure to cancel a booking at least 24 hours in advance or repeated no-shows (e.g., 3 or more instances) may result in:

  • A temporary suspension of booking privileges, or

  • Termination of lifetime access without refund, at Our discretion.

4.4.2. Exceptions:

• Emergencies (e.g., medical or documented incidents) may be considered for excusal upon proof.

5. Safety and Conduct
5.1. Customers must follow all safety protocols when handling chemicals and equipment.
5.2. No food or drink is permitted in the Darkroom.
5.3. Violation of safety rules may result in immediate expulsion and revocation of membership without refund.

6. Damage and Penalties

6.1. Liability for Damage:

• The Customer is fully responsible for any damage to equipment, facilities, or property caused by negligence, misuse, or failure to follow instructions.

• If damage occurs due to the Customer’s actions, they must report it immediately to staff. Failure to identify may result in revocation of membership.

6.2. Penalty Fees:

• The Customer agrees to pay either:

  • The full replacement or repair cost of the damaged equipment (as assessed by Us), or

  • A one-time penalty fee (determined at Our discretion, not exceeding HKD 5,000 if full replacement is not required.

• Payment must be made within 7 days of notification.

6.3. Failure to Comply:

• Unpaid penalties will result in suspension of Darkroom access until resolved.

• Legal action may be pursued for significant damages or refusal to pay.

7. Liability
7.1. We are not responsible for any personal injury, loss, or damage to personal property.
7.2. Customers use the Darkroom at their own health and safety risk.

8. Modifications to Terms
8.1. We reserve the right to update these Terms at any time. Continued use of the Darkroom constitutes acceptance of the revised Terms.

9. Governing Law
9.1. These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR.

By using the Darkroom, you acknowledge that you have read, understood, and agreed to these Terms.
